1 - Short Title and Enactment
(1) This Act may be cited as the ‘Speaker of Parliament Act’.
(2) This Act shall be numbered as P.B.00-025.
(3) This Act shall be enacted immediately upon its signage.
(4) This Act has been authored by Deputy Prime Minister TheReal42Person.
(5) This Act has been co-sponsored by Minister winterwolf.
2 - Reasons
(1) No party would want to run a Member of Parliament to become Speaker, as the Speaker has no voting power, but fills a seat in Parliament.
(2) The abilities of the Speaker of Parliament are not defined clearly.
(3) There is currently no way to remove the Speaker of Parliament from power.
3 - The Legislative Branch Act shall be amended as follows:
‘5 - Speaker of Parliament
(1) The Speaker of Parliament primarily serves to facilitate debate and discussion, keep the chamber in order, efficiently administer the legislative process, enable transparency with the public, and fulfill any other duties given to them in the Constitution.
(2) The Speaker of Parliament shall remain unbiased towards all legislation, debate, Members, reports, and any other actions taken by Parliament.
(3) The Speaker of Parliament election shall take place immediately upon the transfer of power after a General Election.
(a) A 24-hour nomination period shall take place, followed by a 24-hour voting period.
(b) The Member of Parliament who receives a majority of the votes shall be elected Speaker of Parliament.
(4) In the event of a tie on any action (i.e. bill, resolution, motion) by Parliament, the Speaker of Parliament must cast a tie-breaking vote in favor of the status quo.
(5) The Speaker of Parliament may be removed through a Vote of No Confidence outlined in Section 14 of this act.’
Subsequent sections shall be renumbered to reflect this addition. Section 14 is Section 13 prior to this act.
4 - Section 13 of the Legislative Branch Act shall be amended as follows:
‘(2) Motion of No Confidence
(a) A motion of no confidence may be made against a specific individual in the government (not the opposition), the Speaker of Parliament, or against the government as a whole.
(b) Members shall have an opportunity to respond to the motion as follows:
(i) When made against a specific member of the government or the Speaker, the individual in question has 12 hours to provide a written response to the motion in #parliament-floor. This response will be posted along with the vote.
(ii) When made against the government as a whole, the Prime Minister must provide a written response within 12 hours in #parliament-floor. This response will be posted along with the vote.
(iii) If no response is made, the Speaker shall put the motion to vote with no response.
(c) If the motion against an individual passes, the individual in question shall be stripped of all positions except for Member of Parliament.
(d) If the motion against the whole government passes, the entirety of the government shall be forced to resign. If a new government is not formed within 7 days, a general election shall be called.
(e) This motion requires a supermajority (or two-thirds majority) to pass.’
