Establish families in the Kingdom of Alexandria​


1 - Short Title and Enactment
(1) This Act may be cited as the 'Families and Adoptions Act.'
(2) This Act may be numbered as P.B.00-002
(3) This Act shall be enacted immediately upon its signage.
(4) This Act has been authored by Minister winterwolf.
(5) This Act has been cosponsored by Prime Minister Casualgrayknight.

2 - Reasons
(1) To establish a method to create families and to create a public record
(2) To prevent people from making multiple families
(3) To promote roleplay aspects of StateCraft
(4) Note: Heavily referenced the ‘Adoptions Act’ and ‘Marriage Act’ of Redmont, thank you to all players who contributed to these acts and anyone who helped create/amend these act should be credited

3 - Definition
(1) Defines ‘adoption’ as “The formal process of an individual or a married couple assuming the rights of a parent for a player”

(2) Defines ‘parents’ as “Individuals who have the ethical responsibility to take care of their child”

(3) Defines ‘family’ as “a group of people consisting of at least one parent and one child to create a lineage”

(4) Defines ‘lineage’ as “The public record of the ancestral line of a family”

(5) Defines ‘head of the lineage’ as the player ‘oldest generation’ of the lineage tree who has been active for at least 1 hour in the last 30 days. If there are multiple players in the oldest active generation of a family, then the player who joined the lineage first will be considered ‘head of the lineage’. The current ‘head of the lineage’ can transfer the position to another player, which would supersede the highest generation/eldest player description.

(6) Defines ‘marriage’ as “The legal union of two consenting players facilitated by an officiant with a royal marriage license.”

(7) Defines ‘spouse’ as “The legally recognized partner married to the player.”

(8) Defines ‘in absentia’ as “When a spouse has been inactive for over one month”

(9) Defines ‘prenuptial agreement’ as “A binding contract signed by both partners outlining extra terms of a marriage”

(10) Defines ‘marriage officiant’ as “A player who possesses a royal marriage license”

(11) Marriages and families recognized on other servers will not be recognized in the Kingdom of Alexandria.

4 - Registration
(1) The Ministry of Internal Affairs will provide a place for players to apply for marriage and adoption.
(a) To apply for marriage, the following screenshot(s) must be provided:
(i) The marriage officiant stating: “We are gathered here today to witness the union of [Player 1] and [Player 2]. “Do you, [Player 1], wish to take [Player 2] as your spouse?”
(ii) Player 1 states: “I do”
(iii) Followed by the marriage officiant stating: “And do you, [Player 2], wish to take [Player 1] as your spouse?’
(iv) Player 2 states: “I do”
(v) Followed by the marriage officiant stating: “By the power vested in me by the Royal Authority of Alexandria, King/Queen/Monarch [Player], I pronounce you married.”
(vi) The wording, grammar, and/or sentence structure of the text above can be slightly different, as long as the meaning remains the same.
(vii) The Minister of Internal Affairs will check this during the marriage application.
(viii A marriage is considered ‘official’ only when the screenshot is provided in the place where marriage applications are, and has received official approval by the Minister of Internal Affairs.

(2) The Ministry of Internal Affairs will provide a place for players to list their lineages.
(a)It is the responsibility of the head of the lineage to continue updating the family tree.
(i) The family tree must be displayed as a genealogy or a pedigree chart.
(ii) The head of the lineage is also responsible for declaring the name of their lineage.

(3) A player cannot marry themselves.

(4) A player cannot adopt themselves.

(5) A player may have multiple spouses.

5 - Clarification
(1) Parents are not obligated to give their children anything besides what they feel is appropriate.

(2) A player can only be in one family at a time. To join a new family, the player must state in their adoption thread that they are leaving their current family.

6 - Legal Protections
(1) Players may be represented by their spouses in absentia on any and all legal matters.

(2) Players are not obligated to testify as a witness against their spouse.

7 - Shared Financials
(1) Married couples can choose to share their finances with each other if they both consent on their marriage registration thread.

(2) Married couples may decide what to do with their assets if a spouse declares their intent to leave the server, are inactive for over 2 months, or any other action which may indicate their disappearance from StateCraft.
(a) Players who allow their assets to be inherited must say so directly on their marriage registration thread that their spouse(s) have access.
(b) The player can retrieve the assets from their spouse via a ticket to the Ministry of Justice
(i) An asset seizure warrant is required for documentation and should be pasted on the marriage registration thread.

8 - Divorce
(1) If both spouses state they want to deregister a marriage, they must contact the Ministry of Internal Affairs to have it deregistered.

(2) If only one spouse wishes to deregister a marriage, then they must file for divorce in court if they wish to have a marriage deregistered.

(3) If a spouse disputes the divorce, then the court will decide on how assets will be divided; with the exception of a prenuptial contract that states otherwise.

9 - Divorce (2)
(1) If spouses choose to deregister a marriage, they must inform the Ministry of Internal Affairs of who has custody of their adopted children. This should also be done on the adoption thread of the child. The head of the lineage has responsibility to update lineages after any lineage changes.
(2) Custody can be done by:
(a) One spouse with complete custody.
(b) Shared custody between the two spouses.
(c) Abandon their child completely.

(3) In the event that divorced spouses cannot determine a custody agreement privately, they must file for custody in Court to reach a court-ordered custody agreement.

(4) There will be no required child support.

10 - Step-Parent
(1) If a spouse has child(ren) from a previous marriage, or a single parent and remarries, their new partner may opt to adopt the child(ren) with permission from both the parent and child.

(2) If a spouse has child(ren) from an existing marriage, the new partner may opt to adopt the child(ren) with permission from both parents and the child.

11 - Widows
(1) If a married individual’s spouse has not joined the server in two months, or has declared their intent to leave the server, the following shall apply:
(a) Any existing prenuptial agreement pertaining to the marriage shall be nullified.
(b) Both parties shall keep any assets obtained during, before, or after the marriage.
(c) The marriage shall be marked as deregistered.
(d) The child(ren) shall be put into custody of the parent who has joined the server in the last two months and has not declared their intent to leave the server.

(2) If both spouses have not joined the server in 2 months and/or have declared their intent to leave the server, the marriage shall remain registered.

12 - Marriage Officiant License
(1) The currently reigning Monarch has the authority to grant and revoke royal marriage licenses at their own pleasure.
(a) The Royal Family must maintain a publicly available list of all players who hold this license.

(2) A marriage officiant must have a Marriage Officiant License at the time of the marriage, otherwise the marriage will not be considered valid.
